Terms of Service

These terms govern your use of the software and services provided by Cekap Apps Enterprise, trading as CekapApps ("we", "us"), including LejarKu and AkademiHQ (each a "Service"). By creating an account or using a Service, you agree to these terms.
1. Who we are
Cekap Apps Enterprise, a business registered in Malaysia with the Companies Commission of Malaysia (SSM) (Registration no. 202603193101 (SA0656041-P)), trading as CekapApps, business address 2, Jalan Kemuning Prima 33/51E, Kemuning Utama, Seksyen 33, 40400 Shah Alam, Selangor, Malaysia. 2. Your account
- You must provide accurate registration details and keep them up to date.
- You are responsible for keeping your password secure and for everything that happens under your account. Tell us immediately if you believe it has been compromised.
- You must be at least 18 years old, and if you are registering on behalf of a business you confirm you are authorised to bind that business to these terms.
- One subscription covers one business. You may add users up to the limit of your plan.
3. Acceptable use
You agree not to use a Service to:
- break any Malaysian law, or any law that applies to you;
- store or publish content that is unlawful, obscene, defamatory, or that infringes someone else's rights — this includes any images you upload to a public product catalogue, which we screen and may remove;
- sell goods or services you are not lawfully permitted to sell;
- attempt to gain access to another customer's data, probe or disrupt our systems, or circumvent any limit or security control;
- resell, sublicense or white-label the Service without our written agreement.
We may remove content or suspend an account that breaches this section. Where the breach is not serious we will contact you first.
4. Your data
Your business data belongs to you. We claim no ownership of the sales, customer, student or product records you enter. We process them only to provide the Service to you, as described in our Privacy Policy.
- You can export your data at any time from within the Service.
- We keep automated backups so that we can restore the Service after a failure.
- If you close your account we will delete your data within 90 days, except where we are required by law to keep records for longer.
- You are responsible for the lawfulness of the personal data you put into the Service — for example, the customer or student records you collect.
5. Fees and payment
- Subscription fees are those published on our pricing page at the time you subscribe, in Malaysian Ringgit.
- Fees are payable in advance — monthly or yearly, as you choose.
- Payment terms, accepted methods and what happens when a payment fails are set out in our Payment Policy.
- Refunds and cancellations are governed by our Refund Policy.
- We may change our prices with at least 30 days' notice by email. A price change never applies to a period you have already paid for. If you do not accept a new price you may cancel before it takes effect.
6. Term, cancellation and suspension
Your subscription continues until cancelled. You may cancel at any time from within the Service or by contacting us; your access continues until the end of the period you have paid for.
We may suspend or terminate an account if fees remain unpaid after we have given you notice and a reasonable chance to pay, if you materially breach these terms, or if we are required to by law. Except in cases of serious misuse, we will give you notice and an opportunity to export your data.
7. Availability and support
We work to keep the Services available at all times, but we do not promise uninterrupted service. We may carry out maintenance, and will give advance notice of planned maintenance where reasonably possible.
Support is provided by email and WhatsApp during Monday to Friday, 9am – 6pm (MYT), excluding public holidays. We aim to respond to every message within one working day.
8. Intellectual property
The Services, including all software, design and branding, are owned by CekapApps and protected by the Copyright Act 1987 and other applicable laws. We grant you a non-exclusive, non-transferable right to use the Services for your own business for as long as your subscription is active. Nothing in these terms transfers ownership of our software to you.
9. Liability
Nothing in these terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, or for fraud.
Subject to that, and to the extent permitted by Malaysian law:
- the Services are provided on an "as is" basis;
- we are not liable for indirect or consequential loss, or for loss of profit, revenue, goodwill or anticipated savings;
- our total liability to you in any twelve-month period is limited to the amount you paid us for the Service in that period.
You remain responsible for your own tax filings and statutory records. Our software helps you keep records; it is not accounting, tax or legal advice.
10. Changes to these terms
We may update these terms. If a change materially affects your rights we will give you at least 30 days' notice by email. Continuing to use the Service after a change takes effect means you accept the updated terms.
11. Governing law
These terms are governed by the laws of Malaysia, and the courts of Malaysia have exclusive jurisdiction over any dispute. Nothing here affects rights you may have under the Consumer Protection Act 1999 where it applies to you.
